Supreme court Nigeria to hold a valedictory session tomorrow, 10th of October, 2023. in honour of Justice C.C.Nweze. who died on the 30th of july.

The valedictory court session and funeral arrangements for the late Supreme Court Justice, C.C. Nweze, who passed away on 30th of july, 2023 upon to the announcement by the National judicial commission . 

The valedictory court session will take place on Tuesday, October 10th, 2023 at 10:00am at the Supreme Court complex in Abuja. A requiem mass will also be held at Holy Trinity Catholic Parish in Maitama Abuja on the same day at 4:00pm.

Other requiem masses to be held in his honour are as follows ; on Friday, October 13th at 4:00pm at CKC G.R.A in Enugu, and on Friday, October 20th at 11:00am at St. Pius in Umuezejor Obollo Afor. 
PERSONAL DATA
Hon. Justice Chima Centus Nweze, a native of Obollo, Udenu Local Government Area of Enugu State, was born on September 25, 1958. A practising Christian of the Roman Catholic Denomination, he is married to Hon Justice Ugonne Jacinta Nweze of the Enugu State Judiciary. Their union is blessed with five children and a grandchild.
ACADEMIC CAREER
He attended St John Cross Seminary, Nsukka, from 1972 -1977, emerging with a Distinction in the West African School Certificate Examination, [WASCE]. Between 1979 – 1983, he was an undergraduate student at the University of Nigeria, Enugu Campus. In 1983, he represented the Faculty of Law, and indeed, all Nigerian Law Faculties, at the Phillip Jessup International Law Moot Court Competition in Washington DC, as the Chief Oralist. Upon his graduation in 1983, [LL. B. (Hons) (Nig.)], he proceeded to the Nigeria Law School, from 1983 - 1984, where he obtained the qualifying Certificate, [BL]. He did his NYSC between 1984 – 1985 in Bauchi.

Subsequently, he returned to the University of Nigeria, Enugu Campus, between 1993 – 1995, where he studied for, and obtained, the Master of Laws Certificate, [LL. M]. Between 1997 – 2001, he studied for, and achieved, the Doctorate Degree [Ph. D.] of the same university, the University of Nigeria.

JUDICIAL CAREER
Having practised at the private Bar from 1985 – 1995, he was elevated to the High Court Bench of Enugu State in November, 1995. While on the High Court Bench, he served as Chairman, Second Robbery and Firearms Tribunal, Enugu State, 1996 -1998; Chairman, Robbery and Firearms Tribunal, Nsukka, 1998 -1999; Member, Ondo State Local Government Election Petition Tribunal, 1999; Chairman, Ogun State Governorship and Legislative Houses Election Petition Tribunal, 1999; Administrative Judge, Nsukka Judicial Division, Enugu State, 2001. He was appointed a Justice of the Court of Appeal of Nigeria, February 15, 2008; and served thereat until October, 2014, when he was, finally, elevated to Nigeria’s apex court as a Justice of the Supreme Court of Nigeria, October 29, 2014. He has been on the Bench of the Supreme Court from October, 2014 – Date.

Justice Nweze has delivered several landmark judgments and rulings, including the 2019 judgment that upheld the victory of Governor Samuel Ortom in the Benue State governorship election, the 2020 judgment that upheld the deregistration of some political parties by the Independent National Electoral Commission, and the 2021 judgment that upheld the validity of the Niger State governorship election won by Governor Sani Bello.

The First Major Casualty of Section 83 of the Electoral Act 2026 May Have Emerged

The recent decision of the Federal High Court in Fubara Dagogo v. All Progressives Congress (APC) & 3 Ors., Suit No. FHC/ABJ/CS/591/2026 delivered by Justice Joyce Abdulmalik, represents a significant development in Nigeria’s pre-election jurisprudence. In that case, the court struck out the suit challenging the APC National Congress and proceeded to award punitive costs of ₦10 million each against the plaintiff, Mr. Fubara Dagogo, and his counsel, Chief Sir O.A.U. Onyema, for what the court considered a frivolous and non-justiciable action. I had the rare  privilege of participating as a panelist at the Biennial Law Week of the Nigerian Bar Association, Anaocha Branch, Anambra State this weekend,  where distinguished Professors of Law, Justices of various courts, Senior Advocates of Nigeria, and legal scholars gathered to interrogate one of the most pressing challenges confronting the Nigerian judiciary today: "the growing menace of conflicting judgments and the urgent need for judicial reforms". Section 83 and the Myth of Judicial Silence in Party Politics

The recent assertion by my brother, Festus Okoye Esq, that lawyers have become scapegoats in internal party conflicts owing to their recourse to the courts calls for careful constitutional and judicial interrogation. At the centre of this debate lies Section 83 of the Electoral Act 2026, particularly the suggestion that it absolutely ousts the jurisdiction of the courts over the internal affairs of political parties. With the greatest respect to lawyers who are holding this view, that broad interpretation may appear overstretched and not constitutionally sustainable. Section 83(5) of the Electoral Act, read in isolation, appears to bar courts from entertaining disputes relating to party internal issues absolutely.  On a literal reading, it suggests a legislative intent to shield political parties from judicial scrutiny. tribunal orders a rerun in ideato North federal constituency election held on 25 February, 2023.

Tribunal sitting over ideato North/south Federal Constituency election, nullifies the election of Ugochinyere of peoples democratic party (PDP), Held on 25th February, 2023. In a unanimous decision on Sunday, a three-member panel of the tribunal which conducted its proceedings in Nasarawa State, held that Ugochinyere was not validly nominated by the PDP to contest the Ideato North/South Federal Constituency election that held on February 25. In its lead judgement, delivered by its Chairman, per Justice Anthony Olotu Akpovi, the tribunal specifically directed the electoral body to conduct the supplementary poll in 55 polling units where elections did not hold on February 25. The tribunal however,  ordered the Independent National Electoral Commission, INEC, to conduct a supplementary election in the constituency within 90days.
