The three-member panel of the tribunal led by Justice Kudirat Murayo dismissed the petitions of the Labour Party and its candidate, Chijioke Edeoga, insisting that they could not prove their petitions.
In dismissing the petitioners’ petition, the tribunal declared that the National Youth Service Corps discharge certificate is not a qualification to contest a governorship election
The court ascertained whether “Assuming that the NYSC discharge certificate of the second Respondent as claimed by the Petitioners was forged, is the NYSC Certificate a qualification to contest for Governor in Nigeria according to the constitution? The answer is no.”
Justice Akano explained that the fact that Governor Mbah had not submitted his NYSC certificate to INEC as part of his qualification to run for the governorship office. He was already deemed qualified for the position without the NYSC certificate.
Consequently, the tribunal held that the LP governorship candidate, Hon. Chijioke Edeoga, failed to provide admissible evidence to substantiate his claims that Governor Peter Mbah’s certificate was forged. Hence, the tribunal upheld Governor Mbah’s victory in the election.
