US COURT REJECTS DISCOVERY REQUEST AGAINST PRESIDENT TINUBU IN FREEDOM OF INFORMATION LITIGATION

By Michael Obinna Ochili, Esq. | Legal Diary News

A United States District Court for the District of Columbia has rejected an application seeking permission to obtain information from Nigerian President Bola Ahmed Tinubu and DCI Group in ongoing litigation concerning access to federal investigative records.

In a ruling delivered on 30 October 2026, Justice Beryl A. Howell dismissed the application filed by American researcher Aaron Greenspan, holding that the proposed discovery was not sufficiently relevant to the issues before the court.

The proceedings arose from requests submitted under the United States Freedom of Information Act (FOIA), seeking access to records connected with federal investigations conducted in the early 1990s.

During the litigation, Greenspan sought permission to obtain information concerning alleged cyberattacks on his website and matters involving DCI Group.

However, the court held that the proposed discovery would not materially assist in determining whether the relevant federal agencies had conducted adequate searches or lawfully withheld records.

The judge consequently refused the application for limited discovery.

Legal Implications

The ruling reinforces the principle that discovery applications must be relevant to the substantive issues in dispute.

It also demonstrates that the judicial process cannot ordinarily be extended to investigate matters unrelated to the questions requiring determination.

Importantly, the ruling concerned a procedural discovery request and did not constitute a determination of criminal allegations against President Tinubu.

Reporter's Analysis

The decision highlights the importance of procedural discipline in litigation.

Although litigants are entitled to pursue evidence necessary for establishing their claims, the courts retain the responsibility to prevent proceedings from being diverted into collateral controversies.

The case offers useful guidance on the relationship between access to public information, judicial discretion and the permissible scope of discovery.
