ENFORCEMENT OF LEGAL PRACTITIONERS’ REMUNERATION ORDER 2023: NIGERIAN LAWYERS URGED TO UPHOLD PROFESSIONAL FEE STANDARDS

Implementation of the Remuneration Order remains crucial to protecting lawyers against professional undercutting and ensuring fair compensation for legal services.

By Legal Diary News | 22 October 2026

The enforcement of the Legal Practitioners’ Remuneration (for Business, Legal Services and Representation) Order 2023 continues to attract attention within the Nigerian legal profession, particularly concerning professional fees, compliance with prescribed remuneration scales and disciplinary consequences for violations.

The Order establishes minimum remuneration standards for specified legal services, aimed at promoting fair compensation, professional dignity and ethical legal practice.

Despite its introduction, concerns remain over inadequate awareness, professional undercutting and inconsistent compliance among legal practitioners.

LAWYERS MUST COMPLY WITH PRESCRIBED FEES

Under the Remuneration Order, legal practitioners are expected to charge fees in accordance with the applicable prescribed scales.

Order 10 provides a mechanism for seeking approval to charge below the prescribed remuneration, subject to stipulated conditions and timelines.

Lawyers who disregard applicable requirements may expose themselves to professional disciplinary consequences.

NBA URGED TO STRENGTHEN ENFORCEMENT

Effective implementation requires sustained collaboration between the Nigerian Bar Association, relevant remuneration committees and legal practitioners.

Greater awareness, monitoring and enforcement are necessary to discourage unethical fee practices and protect the economic interests of lawyers, particularly young practitioners.

However, enforcement must remain consistent with due process and applicable professional regulations.

LEGAL SIGNIFICANCE

The Remuneration Order represents an important regulatory framework for strengthening professional standards and ensuring that legal services are appropriately valued.

Its effective implementation could improve lawyers' financial sustainability, discourage unhealthy competition and promote greater professionalism.

CONCLUSION

The legal profession must recognise that fair remuneration is essential to maintaining professional independence, dignity and quality legal representation.

Lawyers must uphold the prescribed remuneration standards while the NBA and relevant regulatory institutions strengthen awareness, compliance and enforcement.

A legal profession that values its services appropriately is better positioned to protect its independence and serve the administration of justice.
