In a recent development, the Court of Appeal in Lagos has affirmed the victory of Senator Tony Nwoye of the Labour Party in the Anambra North Senatorial District election held on February 25, 2023. The appeal filed by Stella Oduah, a former aviation minister and member of the Peoples Democratic Party (PDP), challenging Nwoye's win, was dismissed by the court.
Background:
The National Assembly Election Petition Tribunal in Awka, Anambra State, had previously dismissed Oduah and the PDP's petitions, citing a lack of merit. Not satisfied with the tribunal's ruling, Oduah and the PDP filed appeals with the Court of Appeal, marked CA/AW/EP/SEN/AN/03/2023 and CA/AW/EP/SEN/AN/04/2023.
Court's Ruling:
The Court of Appeal, in its judgment, resolved the issue of nomination against Oduah. It emphasized that the nomination of candidates is a domestic affair of a political party and not justiciable. The court further stated that Oduah had no standing to challenge the membership of the Labour Party, as only an aspirant in the primary election can challenge such matters.
According to the Independent National Electoral Commission, Nwoye secured 94,779 votes, while Oduah received 50,146 votes in the election. Oduah had previously represented Anambra North for eight years.
