AKURE STATE HIGH COURT HAS STRUCK OUT THE SUIT FOR COMPILATION OF APPEAL FILED BY GOVERNOR AKEREDOLU.
The suit filed by the Ondo State Government and Governor Oluwarotimi Akeredolu regarding the compilation of the record of appeal has been dismissed by the High Court in Akure, Ondo State.
The suit was filed against four registrars of the High Court, the Deputy Governor, the House of Assembly, the Speaker of the House, and the Chief Judge of Ondo State. It claimed that the procedure for settling and compiling the record of appeal for the Deputy Governor's appeal would infringe on their rights.
The matter was heard on Monday, 6th November 2023, before Justice D. I. Kolawole. During the hearing, the claimants' counsel orally applied to withdraw the suit, stating that it had become irrelevant due to subsequent events.
In his response, counsel for the Deputy Governor opposed the oral application to withdraw the suit, contending that that parties had joined issues by filing a defence and a counterclaim to the suit.
In his ruling, Justice D. I. Kolawole stated that the Court's rules allow the claimants to withdraw the suit, and as a result, it was struck out.
The counsel representing the Deputy Governor requested the Court to instruct the parties to maintain the status quo, in order to preserve the subject matter of the ongoing suit. However, this application was opposed by the counsel representing the House of Assembly.
Hearing the application, the judge ordered all parties involved in the suit to continue maintaining peace. The matter was subsequently adjourned to November 22, 2023, for the hearing of the application.
